Terms & Conditions

In this Agreement:

“Customer”

means any person who places an Order with Nisbets;

"Goods"

means any items sold or supplied by Nisbets under an Order;

"Nisbets"

mmeans Nisbets Australia Pty Limited (ACN 139 667 191) of 15 Badgally Road, Campbelltown, NSW 2560;

"Order"

means any request or order to purchase the Goods;

"Special‑to‑Order"

means any Goods that are special order, despatched by a third party supplier (including back-to-back Goods) or are direct to the Customer. These Goods will be highlighted on the Nisbets website, in the catalogue or within quotes and invoices; and

"Parties"

refers to the Customer and Nisbets.

1. This Agreement is the only form of contract between the Parties and any Customer terms and conditions will not apply unless expressly agreed in writing. By submitting an Order, whether through Nisbets website or through one of its catalogues, stores or call centre, the Customer agrees to apply the terms and conditions of this Agreement in priority over any other agreement between the Parties except previously agreed Nisbets Credit Account terms and conditions which, where conflict arises, take precedence over this Agreement.
2. Any Order is subject to acceptance by Nisbets. Nisbets is not obliged to accept any Order or to justify refusal of the same. Receipt of payment for Goods by Nisbets does not in itself constitute acceptance by Nisbets of the Order.
3. Nisbets may vary the terms and conditions of this Agreement from time to time by publishing new terms and conditions on the Nisbets website or catalogue.

1. Descriptions and specifications for the Goods are set out on the Nisbets website at the time of the Order or the Nisbets catalogue from which the Order is placed provided the catalogue is current at the time of the Order.
2. If any Goods are unavailable or out of stock then Nisbets may cancel the Order in whole or in part and refund any monies paid, issue a credit note or otherwise vary the Order with the Customer's approval.
3. Customers placing Orders for age-restricted goods such as solvents and knives confirm that they are over 18 years of age and that delivery will be accepted by a person over 18 years of age.

1. Current prices for Goods are available on the Nisbets website or its latest catalogue. Prices may change from time to time. Occasionally, there may be a difference in price between the Nisbets website and its catalogue. Nisbets is under no obligation to honour a website price if the Order is placed through the catalogue. Nisbets is under no obligation to honour prices advertised in old catalogues. A delivery and/or insurance charge may be payable in addition to the price of the Goods which will be notified to the Customer before the Customer submits the Order. All prices are quoted in Australian Dollars.
2. Unless otherwise stated, all prices quoted exclude GST. GST will be charged in accordance with the relevant regulations in force at the time of the Order.
3. Occasionally an error may cause the price published or advertised for Goods to be incorrect, in which case Nisbets will be under no obligation to honour the incorrect price.
4. Payment for Goods and Delivery may be made by any of the options listed on the Nisbets website or catalogue, depending on the method of placing the Order. Bank/Electronic Fund Transfers must include the Order reference number as a payment reference and be made to:

5. Nisbets reserves the right to charge interest on late or overdue payments by the Customer.
6. All Orders may be subject to further credit or security checks.
7. Nisbets's Price Match applies to any lower published price for a like-for-like product offered on the same terms in Australia. Like-for-like means Goods should be the same brand and specification. The goods must be offered with the same delivery service and warranty as Nisbets's and the competitor must have stock availability at the time of ordering. The price will not be matched where there are 'hidden extras' such as delivery charges. In order to qualify, the price must be published in writing. Nisbets's Price Match excludes comparing like-for-like products from companies within the Nisbets group of companies.

1. Full delivery prices and options are listed on the Nisbets website or catalogue and are subject to change from time to time.
2. Certain large, heavy or bulky items and deliveries to offshore/remote deliveries (including Tasmania) will attract higher delivery prices and delivery times will be longer, depending on the delivery location. Delivery prices and times for these items will be discussed for confirmation with the Customer after an Order has been placed.
3. Nisbets will use reasonable endeavours to ensure its delivery agents meet delivery estimates. However Nisbets cannot be held liable for any delay in delivery.
4. Risk in the Goods transfers to the Customer at the time of delivery but title will not pass until payment has been made in full for the Goods in question. Customers are advised to notify Nisbets immediately if Goods are delivered in damaged or soiled packaging.
5. Goods delivered are used, stored and installed at the Customer's own risk and Nisbets will not be liable for any damage, loss or disruption caused by the same unless caused by Nisbets's negligence. Where installation/disconnection services have been ordered by the Customer, further charges, terms and conditions may apply as communicated by Nisbets to the Customer before delivery.
6. All large machinery, refrigeration and flat packed Goods are delivered to the front door of ground floor locations only. The delivery person/driver may at his/her discretion assist with delivering the Goods to a location within the premises nominated by the Customer, at the Customer's sole risk.
7. If (i) the Customer will not or does not accept delivery when the Goods are ready for delivery or (ii) Nisbets or its agent cannot effect delivery because Nisbets or its agent considers at the time of delivery that delivery would be hazardous or would be contrary to their policies, industry practice or statutory requirements or (iii) because the Customer has not provided Nisbets with appropriate instructions, documents, licences or authorisations to properly, legally and safely effect delivery of the Goods, risk in the Goods passes to the Customer, the Goods will be deemed delivered, and Nisbets may store the Goods until actual delivery, in which case, the Customer will be liable to Nisbets for all related costs, such as re-delivery charges, storage and insurance.

1. Goods delivered may be returned for a refund, exchange or replacement within 30 days provided they are returned unused, in a saleable condition and in their original packaging. Certain large or bulky items may be subject to a restocking fee. Certain Goods cannot be returned for hygiene purposes. Certain Goods such as knives must be returned in adequate postal packaging for health and safety reasons. The cost of returns may be refunded in whole or in part to the Customer at Nisbets’ discretion.
2. Certain last-in-line or Special-to-Order Goods are not returnable. Those Goods will be flagged accordingly on the Nisbets website, in the catalogue or within quotes and invoices. These Goods are excluded from out 30 day Hassle Free Returns.
3. Goods that are damaged on delivery must be reported to Nisbets within 24 hours. Large Goods such as fridges must be visually inspected by the Customer on delivery for damage and an acceptance of delivery docket completed noting any damage that resulted from delivery. Goods that are missing, delivered faulty or defective by Nisbets may be replaced, repaired, refunded or exchanged at Nisbets's discretion provided Nisbets is informed in writing within 28 days. Certain Goods may be disposed of in accordance with Nisbets safety instructions for replacement, refund or exchange with Nisbets's prior approval.
4. Clauses 5.1 to 5.3 above do not apply to any defect in the Goods caused by the fault, negligence or failure of the Customer to adhere to manufacturer instructions. Engineer call-outs and repairs carried out on non-warranty faults or defects may be subject to further charges. No Goods will be sold on a 'sale or return' basis without the prior written approval of Nisbets.
5. Statutory rights for Customers placing Orders under $100,000 as private consumers for personal, domestic or household use (as defined by law) are not affected.
6. Notwithstanding any other clause of these Terms and Conditions, where a Customer is deemed to be a Consumer and to the extent provided by law, Nisbets guarantees that any Goods will:
   1. be of acceptable quality;
   2. match the provided description;
   3. meet any express warranties; and
   4. be fit for purpose.

1. Nisbets reserves the right, by notice to the Customer, to cancel or suspend any Order where payment has not been received in accordance with clause 3 above.
2. Nisbets reserves the right to terminate this Agreement if the Customer cannot pay its debts or becomes bankrupt or has a winding-up order made or an administrator, liquidator, receiver or similar is appointed over the whole or a substantial part of the assets and undertaking of the Customer.
3. Nisbets reserves the right to suspend or terminate performance of this Agreement where delivery or supply of the Goods and/or performance of this Agreement is affected by reasons out of Nisbets's reasonable control such as force majeure, act of God, adverse weather and government intervention, sanction or legislation.
4. Nisbets reserves the right to cancel any Order where it is reasonably suspected that the Customer is not legally permitted to purchase any Goods specified in the Order (such as solvents and knives).

1. The Customer agrees that Nisbets will not be liable for any losses or damage suffered by the Customer, of any kind, including but not limited to loss of business, business interruption or loss of time, due to the use or purchase of the Goods by the Customer. Nothing in this Agreement shall exclude Nisbets's statutory liability for injury or death.
2. Goods sold are not insured for delivery unless confirmed as insured by Nisbets on acceptance of the Order.

1. Goods sold or supplied by Nisbets may be subject to copyright (whether owned by Nisbets or a third party) and the Customer covenants not to breach, infringe or prejudice any intellectual property and copyright associated with the Goods without approval. The Customer agrees to indemnify and hold Nisbets harmless for any breach of said covenant.
2. The Customer's data protection and privacy rights under this Agreement are set out in Nisbets's privacy policy.

1. This Agreement is governed by the law of New South Wales and the Parties submit to the non-exclusive jurisdiction of the courts of New South Wales.
2. Any right or obligation contained in this Agreement will be distinct and severable and if one or more of the same are declared invalid, illegal, void or unenforceable then the remainder will continue in force and effect to the fullest extent permissible by law.

“Announcement”

means the process by which Successful Participants are selected and announced from the eligible Participants who entered the Giveaway.

"Apuro Products"

means all Goods from the Apuro brand available on the Nisbets Website.

"Giveaway"

means a free-entry competition hosted by Nisbets, in which Participants enter for a chance to win one prize each time they purchased with Nisbets, in accordance with these Giveaway Terms and Conditions.

"Giveaway Terms and Conditions"

means this document, which sets out the rules governing participation in the Giveaway.

"Nisbets Eligible Retail Stores"

meaning Campbelltown, Canberra, South Melbourne, Dandenong, Brisbane, Gold Coast, Sunshine Coast stores.

"Nisbets Head Office"

means 15 Badgally Road, Campbelltown, NSW 2560.

"Nisbets Website"

means www.nisbets.com.au

"Participant"

means any resident of Australia, including New South Wales, the Australian Capital Territory, South Australia, the Northern Territory, Victoria, Queensland, Western Australia and Tasmania, who enters the Giveaway.

"Polar Products"

means all Goods from the Polar brand available on the Nisbets Website.

"Prizes"

means the prizes described in clause 6.1.

"Selected Brands"

means all Nisbets Own Brands listed in Appendix 3.

"Successful Participant"

means a Participant whose entry is selected during the Announcement.

"Voucher"

means a promotional voucher issued by Nisbets with a specified monetary value with a minimum value to spend, redeemable on the Nisbets Website and/or at Nisbets Eligible Retail Stores, subject to any applicable terms and conditions.

1. This incentive giveaway is promoted by Nisbets Australia Pty Limited, a company registered in Australia (ACN 139 667 191) with a registered address at 15 Badgally Road, Campbelltown, NSW 2560, Australia (“Nisbets”, “we”, “us”).

1. The Giveaway will run from 00:00:01 AEST on 1 September 2026 (the "Opening Date") to 23:59:59 AEST on 30 September 2026 (the "Closing Date").
2. By entering this giveaway, Participants agree to accept and abide by these Giveaway Terms and Conditions.
3. The Giveaway will be advertised across social media, email to customers and homepage of Nisbets Website.

1. All Giveaway entries will be received by Nisbets at the time a Participant purchases a minimum of $350 AUD, excluding GST (“Eligible Order”) at one of the Nisbets Eligible Retail Stores, our Nisbets Website or phone orders on 1300 225 960. All Giveaway entries received after the Closing Date are automatically disqualified.

1. This Giveaway is open to only Australian residents aged 18 and any registered business in Australia.
2. This Giveaway is not open to scrutineers, employees and agencies of Nisbets, its subsidiaries, related bodies corporate, their agents and immediate family members of the same.
3. Multiple entries are permitted per business or household.
4. The cost of accessing/participating in the Giveaway online will be dependent on the entrant's individual internet service provider. Any data usage in accessing the application page through a suitable mobile phone is at the cost to the individual and Nisbets shall have no liability whatsoever in respect of the same. Individuals should contact their mobile phone plan provider/internet service provider to ensure this data usage is available within their plan if they are unsure.
5. Incomprehensible or incomplete applications will be deemed invalid. Nisbets may, in its absolute discretion, deem that any application is invalid and such application will not be considered by Nisbets as part of the Giveaway.
6. Nisbets reserves the right to verify the validity of entries and to disqualify any application which, in the opinion of Nisbets, includes objectionable content, profanity, potentially insulting, inflammatory or defamatory statements, disqualify any entrant who tampers with the application process, who submits an application that is not in accordance with these Giveaway Terms & Conditions or who has, in the opinion of Nisbets, engaged in conduct in entering the Giveaway which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Giveaway and/or Nisbets. Nisbets reserves the right to disqualify the Successful Participant if Nisbets becomes aware that the Successful Participant and/or the Successful Participant's application is of a type described in this clause.
7. Any Eligible Order that is subsequently cancelled or returned by the Applicant will be deemed invalid, other than for reasons of the Goods being faulty, pursuant to the Applicant's rights under the Australian Consumer Law.

1. The Prizes available for this Giveaway are listed in Appendix 1
2. There will be a total of 954 prizes, with a combined value of $335,643 AUD, and the giveaway will terminate immediately after the prize has been collected by the Successful Participants. No bonus prizes will be awarded.
3. If any Prize specified in Appendix 1 becomes unavailable, damaged, lost, withdrawn from sale, or cannot be supplied for reasons beyond Nisbets' reasonable control, Nisbets may, subject to applicable laws and regulatory requirements, substitute the Prize with a prize of equal or greater value.
4. Nisbets’s Standard Terms and Conditions of Sale shall apply to all Prizes in all circumstances.
5. No prohibited items including but not limited to tobacco products, alcohol, weapons, explosives and cosmetic procedures will form part of the Giveaway.

1. The Successful Participants will be drawn with an approved electronic drawing system and accompanied by an independent scrutineer on 20 October 2026 at 13:00 AEST. The participants can attend the draw in-person at Nisbets Head Office: 15 Badgally Road, Campbelltown. NSW 2560. (“Announcement Date”).
2. The Prizes will be drawn in ascending order at the announcement.
3. Considering clause 7.1, any Participant may attend the Announcement.
4. Nisbets will contact the Successful Participant personally within 7 days after the Announcement Date, using the email address provided with the giveaway entry.
5. The Prize will be paid or transferred to the Successful Participant within 28 days from the Prizes draw.

1. The Successful Participant will have the choice between delivery at their chosen address or collection of the Prizes at Nisbets Head Office.
   1. All delivery fees relating to the Prizes will be covered by Nisbets.
   2. Notwithstanding clause 8.1.1, additional delivery charges may be incurred by the Successful Applicant following a refusal of the initial delivery attempt.
   3. Delivery of the Prizes is limited to kerbside only and does not include installation or electrical work.
2. Nisbets reserves the right to request the Successful Participant to provide proof of identity, proof of residency or other means of verification acceptable to Nisbets with respect to eligibility.
3. 8.3. If the Successful Participant cannot be contacted by phone (whether because of incorrectly supplied details or otherwise) or does not accept the prize within 14 days from notification by email, Nisbets will hold the relevant prize for 3 calendar months from the date that the first attempt of contacting the Successful Participant was made, before irrevocably withdrawing it. A new Successful Participant will then be re-drawn following the expiry of the 3 calendar months, without delay, at 15 Badgally Road, Campbelltown, NSW 2560 in accordance with these Giveaway Terms and Conditions. The unclaimed prize winner will be notified in writing within seven days; and if the prize is over $250 your last name, first initial and postcode will be published on the landing page of Nisbets Website within 30 days of the major prize draw and/or unclaimed prize draws for a period of 28 days.
   1. If the Successful Participant has entered the Giveaway within the Northern Territory, non-perishable prizes that remain unclaimed after 3 months will be surrendered to the Director of Gaming Control.

1. Your information will be collected or used in the running of this giveaway. In any event, all collected data will be subject to Nisbets Privacy Policy
2. If you are a Successful Participant of a prize valued over $1,000.00 AUD for Victoria and Australian Capital Territory or $250.00 AUD for South Australia, your name, initials suburb and/or postcode will be published on the landing page of Nisbets Website for a period of 28 days.
   1. If in the Northern Territory and your prize is valued at $1,000.00 AUD or more, your name will be published on a local newspaper within 14 days from the Announcement.
3. All records of this Giveaway will be safely stored for 5 years following the end date of the Giveaway and will be made available to an authorised officer or member of the Police Force on request.

1. To the fullest extent permitted by relevant laws, Nisbets is not liable for any loss (including loss of opportunity) or damage (including, but not limited to, direct, indirect or consequential loss) in relation to participation in the giveaway.

1. In the case of the intervention of any outside act, agent or event which prevents or significantly hinders Nisbets’ ability to proceed with the Giveaway on the dates and in the manner described in these Giveaway Terms and Conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, Nisbets may in its absolute discretion postpone the giveaway draw and recommence it from the first working day that the intervention ceases, subject to any applicable laws.
2. Any decision made by Nisbets is final and no correspondence will be entered into.
3. These Giveaway Terms and Conditions are governed by the laws of New South Wales, Australia and each participant submits to the exclusive jurisdiction of the courts of New South Wales, Australia.
4. The rights of a participant under or in connection with these Giveaway Terms and Conditions may not be transferred or assigned.
